We are winning the war even if not this battle. Because let’s face it, criminal charges for throwing a subway sandwich at a cop is hardly up to any rational standards. But while this guy may not be prosecuted, he has an arrest record of resisting police now, and that in and of itself, will be a harder row to hoe. Sometimes we let ourselves get carried away. I think him getting a misdemeanor charge, which probably would have stood, would have been more proper.
