Court strikes complaint.

This complaint stands unmistakably and inexcusably athwart the requirements of Rule 8. This action will begin, will continue, and will end in accord with the rules of procedure and in a professional and dignified manner. The complaint is STRUCK with leave to amend within twenty-eight days. The amended complaint must not exceed forty pages, excluding only the caption, the signature, and any attachment.

Is this a case of incompetent lawyers going cheap and using AI to write the complaint? Or is there some subtle legal game afoot in expensive lawyers deliberately filing a complaint which they knew did not meet the requirements? Or did someone get to the Judge? Or …?

Like almost all complaints now, this complaint was full of irrelevant blather. Routinely, leftists get away with it. Trump wanted to get an old-school judge and he got one.

I would not have recommended the extreme amount of puffery.

Likely, Trump insisted on it.

One of my favorite epithets from law school - “mere puffery”.

Hmmm! So high-priced lawyers getting paid by the hour wrote an 80-page complaint on behalf of their paying client – which took them at least twice as long as writing a 40-page complaint. Maybe they guessed that the Judge would kick back the 80-pager and demand a shorter complaint – which the lawyers would have to write de novo, again while being paid by the hour. If that was the scenario, then poor old President Trump has been billed for three times what he should have been for the complaint … and it is all legal.

Still we wonder why the US has a plethora of lawyers and a pronounced lack of STEM graduates.

Blather is cheap. Verified facts and reasoned arguments are expensive.
