CrowdStrike actively participated in kneecapping Trump days after he was elected and before he was inaugurated. The damage they did to Trump poisoned his entire 4-year term.

I was thinking prior to reading this line that if it is acceptable for euthanasia the argument against cruel and unusual punishment doesn’t seem to apply. Consistency is hard to find these days.

According to Richard Epstein on Law Talk, 18th century England had a list of punishments that were deemed cruel and unusual. The 8th amendment is a referring to that list. As Scalia said, 8th amendment is not about proportionality.
Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.
